The town of Sylva is exploring the possibility of using extraterritorial jurisdiction to zone outside of the municipal borders on Highway 107 past Ingles and along 23/74 around exit 85. Specific land parcels haven’t been identified. State law allows towns Sylva a one-mile ETJ area, but the town is eyeing a smaller boundary than that. ETJ is not annexation, and landowners would not pay town property taxes. But, land included comes under town zoning – the sign ordinance applies, landscape buffers and sidewalk construction would be mandated, and certain types of businesses would require conditional-use permits to open, including animal hospitals, kennels, bars and nightclubs. Sylva has one ETJ now, on Yellowbird Branch Road.
